SHORTEN TERMS OF SERVICE

SHORTEN (hereinafter referred to as “SHORTEN” or “Application”) is owned and operated by Shorten Medya Ticaret Anonim Şirketi . This Terms of Service herein is owned and operated by Shorten Medya Ticaret Anonim Şirketi (“Application”, “SHORTEN”, “us”, “we” or “our”) governing the terms surrounding the use of the Application by Shorten Medya Ticaret Anonim Şirketi shall be valid for all services given to you by Shorten Medya Ticaret Anonim Şirketi. By installing or operating the Applications, you expressly acknowledge that you have reviewed these Terms of Service and agree to be bound by its contents. If you do not agree with these Terms of Service, please do not install and use the Application.

By starting to use the Application, you accept, declare and undertake that you are a natural person who has reached the minimum legal age required in your region to use the Application. If you have not reached that age, then your parent or legal guardian has reviewed and agreed to these Terms of Service; that you are authorised and competent to accept these Terms and to use the Application; that the information and answers we request from you during registration are accurate and belong to you; that you are aware of, accept, comply with and will not violate these Terms of Service and the relevant legislation. You agree, represent and warrant that you will comply with all legal regulations that you may be subject to under the laws of the country in which you are located or of which you are a citizen when using the Application and that SHORTEN will not be liable for any violation of any regulation or any illegal interaction with the Application, to the extent permitted by applicable laws. 

These Terms of Service will provide you the right to use the software applications, web sites, tools, and other features (collectively, the "Services") of the Application. If you are using the Application please note that the transactions you make are binding on you.

We grant you a limited, revocable, nonexclusive, partially or fully non-transferable, non-sublicensable licence to use the SHORTEN Services through a mobile device or an application. We reserve all rights not expressly granted in the Terms, including, without limitation, title, ownership, intellectual property rights, and all other rights and interest in our Services, and all related items. Your contact information that you share with us while creating your profile may be used for marketing and promotional purposes as stated in the Privacy Policy and Clarification Text in accordance with your consent

1.Description of Services and Fees

SHORTEN offers various types of short series that users can watch with the Application within the scope of these Terms of Service.

The Application Content will be accessible by the user in the following ways:

“Subscription": Through the purchase of subscription packages subject to different fees, which may be offered on a weekly, monthly and annual basis, 

“Token Method": By using virtual items called tokens (“Token”) purchased by the user in order to open and watch the In-App Content. Users can earn these virtual items by engaging with specific in-app activities such as watching ads, daily check-ins, or making purchases through supported payment methods. Tokens can be redeemed to unlock additional content within the Application. Coins do not have monetary value, are non-transferable, and cannot be exchanged for cash. We reserve the right to modify or discontinue the Token Method at any time, including altering the methods by which Tokens are earned or redeemed, and limiting the availability of certain content for Token redemption.,

“Reward Commercial": By unlocking sections by watching advertisements. Users can access certain content within the Application for free by watching advertisements. The availability and frequency of ad-supported content may vary depending on the country and content licensing. Advertisements must be fully watched and completed to unlock free content. We reserve the right to limit or restrict ad-supported content at any time. The user agrees to these Terms when engaging with ad-supported content, acknowledging that the advertisements are served by third-party providers, and Shorten is not responsible for the quality or content of these advertisements.

Which parts of the Content and to what extent they will be presented in the above methods is at the sole discretion of SHORTEN and may be changed from time to time. The Application is available on IOS and Android platforms and IOS, Android and the application website can be used for purchases.

Each user may have only one account. You will not be authorised to open and use more than one account. You are personally responsible for keeping your password and protecting the security of your account. On the other hand, there is no obligation to register with the App in order to use the App and Services, and purchases can be made as a guest user through the Token Method and Rewarded Advertising.  

Users can unsubscribe from the Services at any time.

The countries in which the Application is available are at SHORTEN's sole discretion and the countries in which the Application is available may be changed by SHORTEN from time to time. Different fees may be determined and arranged for different countries while purchasing. The user will be notified about the fee before the purchase. However, if users change their settings in Apple accounts and select a different country, the notified fees may vary. We declare that we do not assume any responsibility or commitment in this regard. Fees notified to the user are arranged according to the country which they have selected in the account settings. As long as you do not cancel and unless otherwise stipulated in the Terms of Service, your subscription automatically renews at the end of each service period and proceeds for the length of the previous service period.   

We may offer several different membership plans, including special promotional plans or memberships offered by third parties in conjunction with their products or services. Some membership plans may have different terms and limitations that will be disclosed at the time you sign up for the service or in other communications made available to you.

We wish you to be completely satisfied with our Services. Malfunctions may be encountered from time to time. Without any commitment, we are working on solving the problems that our users encountered by making maintenance and by other actions taken by us to provide you an issueless use of our services. 

To use SHORTEN, you must have a device capable of supporting SHORTEN, Internet access and provide us and/or parties authorised by us with one or more Payment Methods, which may vary depending on the country in which you are located. “Payment Method” means an existing, valid, recognized payment method, which you may update from time to time and which may include payment through your account through a third party. Unless you cancel your membership through third party payment companies before the billing date, you authorize these companies to collect the membership fee of the next billing period through the Payment Method you have chosen.

We may offer several different membership plans, including special promotional plans or memberships offered by third parties in connection with their products or services. SHORTEN makes no commitment and shall not be liable under any name whatsoever for any products or services offered by such third parties. Some membership plans may have different terms and limitations, which will be disclosed when you register for the service or in other communications provided to you

If you have used third parties as a Payment Method and wish to cancel your SHORTEN subscription, you may need to do so through that third party: For example, you can deactivate it by accessing your account with the third party in question and switching off auto-renewal or unsubscribing from the SHORTEN service via the third party You can also find billing information for your SHORTEN subscription by visiting your respective third-party account.

Refund requests for membership fees can only be applied from the place where your transaction was made. If you purchased through the Apple IOS Store or Google Play Store, you can contact us there, if you purchased from our website, you can still contact us to request a refund.  No refunds will be issued for deleted accounts and users who violate our Terms of Service.

2.Termination

The license for use of the Services provided herein is effective until terminated. At our sole discretion, Application may terminate these Terms of Service immediately without notice and we may terminate your use of the Services at any time, without giving reasons. You may terminate the Terms at any time by submitting a membership cancellation request, uninstalling the applications and terminating your use of the services. We reserve the right, without notice and in our sole discretion, to terminate your license to access or use our Services according to your failure to comply with any of the Terms or any applicable laws. You agree that the Application shall not be liable to you or any third party for termination or deactivation and that no refunds will be made in respect of any fees you have already paid.

3.Eligibility

You must be at least 12 years old to access or use our Services. If you have not reached the legal age as defined in your region, you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Any unauthorized use of our Application constitutes a breach. If you are a parent or legal guardian of a user who has not reached the legal age in your region, you agree to be fully responsible for that user’s actions or omissions in connection with our Services

4.Access

You shall provide the necessary equipment, internet connections, devices, and service plans at your own expense to access and use the Application. We do not guarantee that you will have uninterrupted access to the Application. You may be unable to access the Application from time to time due to technical difficulties. If you access the Application via a mobile network, any charges for messages, data, or other fees incurred by your network or roaming provider will be entirely your responsibility to pay. You are responsible for making all arrangements necessary for you to have access to our Services. We do not declare or undertake that the Application is available in all languages, suitable for use in a specific location, or usable in any location. Except as otherwise expressly provided by SHORTEN with respect to the paid portions of the Services, SHORTEN reserves the right, without notice and without liability, to add to, modify, suspend or discontinue the Services or any aspect or feature of the Services to reflect changes in our products, the needs of our users and/or our business priorities.

5.Updates and Support

We reserve the right to add or remove features or functionality to the application. When your mobile phone is set up, the application periodically communicates with our servers. When we release a new version of the Application or if we add new features to it, we may ask you to update the application on your mobile phone. Before you begin to use updated versions of the Application, you may be asked to review it again and may need to accept the updated Terms of Service after reviewing their contents. Continuing to use the Services after the update proves that the User has agreed and accepted the updated Terms.

Not in the sense of any commitment, the Application constantly works to provide suitable and efficient technical support to the services and provides updates and upgrades. Notwithstanding this, the Application is not obliged and declares that it is not responsible under these Terms of Service to provide any support or maintenance for the Services and to make arrangements to enable you to continue to access them with your device as a result of updates and enhancements.. We reserve the right to restrict or terminate the updates, support and maintenance regarding to our Services.

6.Privacy

Please find our Privacy Policy and Clarification Text for detailed information about how we collect, use and disclose the information given by you. Transfer and storage of information about you is governed by our Privacy Policy and Clarification Text aswell.

Data security is provided by the Application. However, the user is responsible for any unauthorized access to user information, contact information and other contents; abusing, storage, reproduction, , copying, as well as illegal use of user information, contact information and other content.

7.Code of Conduct and Prohibited Content

You will not violate any applicable law, contract, intellectual property or other third-party right or commit a tort, and you are solely responsible for your conduct while accessing or using our Services. You shall not do the following when interacting with the Application in any way; otherwise, you will be the sole addressee of all claims and liability: 

  • Use or attempt to use another user’s account without authorization from that user and  SHORTEN ;
  • Create a false identity or otherwise misrepresents your or another true identity;
  • Use our Services in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying our Services or that could damage, disable, overburden or impair the functioning of our Services in any manner;
  • Reverse engineer any aspect of our Services or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of our Services;
  • Attempt to circumvent any content-filtering techniques we employ or attempt to access any feature or area of our Services that you are not authorized to access;
  • Develop or use any third-party applications that interact with our Services without our written consent, including any scripts designed to scrape or extract data from our Services;
  • Use our Services for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms.
  • Engage in any action that directly or indirectly interferes with the integrity of our Services, including but not limited to any attempts to access or hack our servers or network.
  • Using SHORTEN for purposes other than your personal use, and selling, renting, transferring, or sharing your account or any content obtained from your use of SHORTEN with anyone else;
  • Disrespecting or violating the intellectual property rights, privacy, personal rights, or personal data of SHORTEN or third parties, including unauthorized recording, copying, sharing, public transmission, or other forms of distribution of their content.
  • Respect the intellectual property rights of SHORTEN Users, including by not recording, reproducing, sharing, communicating to the public or otherwise distributing their content without authorization.
  • Doing anything that violates our or someone else's rights, including intellectual property rights (examples of which are copyright, trademarks, confidential information, and goodwill), personality rights, unfair competition, privacy, and data protection rights.
  • Using  SHORTEN’s name, logo or any related or similar names, logos, product and service names, designs, or slogans other than in the limited ways which are expressly permitted in the Terms of Service or with our prior written agreement.
  • Engaging in, praising or encouraging behaviours contrary to the applicable legislation and other behaviours that constitute a crime.

In addition, to the  extent permitted by applicable laws, although we have no obligation to screen, edit or monitor user behavior, we have the right to close your account, and file a complaint to the competent authorities at any time and without any reason. However, we declare that we are not responsible for the damages that Users who violate the rules of behaviour in the article may cause to other Users and third parties, and that we do not have any audit or similar obligation in this regard.

Please note that you are not given the permission to use the name, logo or other commercial symbols of the Application. Please read our “Intellectual Property” section for detailed information.

Any violation of this section may cause you to be a subject to legal and/ or criminal penalties.

8.Indemnification

By accepting these Terms of Service, you agree to indemnify, defend and hold harmless  SHORTEN  and each of out respective officers, directors, agents, partners and employees (collectively, the “ SHORTEN Parties”) from and aganist any loss, compensation, punishment, liability, claim, demand, damages, expenses or costs arising out of or related to your actions listed below:

  • Your failure to comply with our Terms, including, without limitation, that anything you submit or contribute violate the rights of any third party or applicable laws;
  • Any use of our Services;
  • Any activity in which you engage on or through the Services
  • Any misrepresentation made by you.
  • Your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights)

You agree and undertake to inform SHORTEN immediately in the event of any third party request, to provide the information and documents we request in such a case and to act in co-operation with SHORTEN and to bear all costs and expenses (including but not limited to attorneys' fees) arising from such request.

9.Abuse of  SHORTEN  Services

SHORTEN has the right to conduct research, close the account and block access to the account for the purpose of establishing, exercising and protecting a right and/or for the legitimate interests of SHORTEN Parties, limited to the subject of violation of these Terms of Service and to collect information about the user, developer or any user who is thought to violate the terms. We inform you that we will collect this data within the framework of our Privacy Policy and Clarification Text.

In its sole discretion, SHORTEN  may restrict, suspend or terminate the account of any User who abuses or misuses the Services. By accepting our Terms of Service herein, you waive and hold harmless SHORTEN Parties from any claims arising out of the action taken by SHORTEN according to such misuse of the Services by either SHORTEN  or law enforcement authorities.

10.Intellectual Property Rights

Our Services and the text, graphics, images, photographs, videos, illustrations, trademarks, patents, trade names, page headers, button icons, scripts, service marks, logos, slogans, filters, copyrighted works and rights, intellectual property rights  and other content contained therein (collectively, the “   Content”) are owned by or licensed to SHORTEN  and are protected by copyright laws and international copyright treaties and all other applicable intellectual property laws.

Using our Service, making a comment or suggestion does not give you ownership of any intellectual property rights in our Services.  SHORTEN  and our licensors reserve all rights in and to our Services and the   Content. You are hereby granted a limited, revocable, nonexclusive, partially or fully non-transferable, non-sublicensable, non-assignable license to access and use our Services and SHORTEN Content for your own personal use. However, such license does not give you the right to (a) sell, resell or commercially use our Services or SHORTEN  Content; (b) copy, reproduce, distribute, publicly perform or publicly display SHORTEN  Content, except as expressly permitted by us or our licensors; (c) use any data mining, robots or similar data gathering or extraction methods; or (d) use or utilise our Services or SHORTEN  Content other than as expressly provided in these Terms. Any use of our Services or SHORTEN  Content other than as specifically authorized herein, without our prior written consent, is strictly prohibited and will terminate the license granted under these Terms. 

11.Copyright and Trademark Complaints

If you believe that anything on our Services infringes any copyright that you own or control, you may notify SHORTEN  through support@shorten.com

12.Disclaimer of Warranties

YOUR USE OF OUR SERVİCES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WHILE SHORTEN ATTEMPTS TO MAKE YOUR ACCESS TO AND USE OF OUR SERVICES SAFE, WE CANNOT GUARANTEE AND WARRANT THAT THE SERVICES PROVIDED ARE ACCURATE, RELIABLE, ERROR-FREE, UNITERRUPTED; THE APPLICATION OR SERVICES OR THE SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE APPLICATION MAKES NO REPRESENTATIONS OR GUARANTEES OR WARRANTIES REGARDING ITS USERS' BEHAVIORS; THE USER SHALL INDIVIDUALLY AND SOLELY BE RESPONSIBLE FOR HIS/HER ACTIONS AND INTERACTION WITH OTHER USERS.

13.Limitation of Liability

IN ACCORDANCE WITH APPLICABLE LAW, YOU AGREE THAT IN NO EVENT SHALL THE APPLICATION BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL DAMAGES OR COMPENSATION ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES, CONTENT. THIS INCLUDES LOSS OF PROFITS, LOSS OF DATA AND LOSS OF BRAND VALUE. IN PARTICULAR, THE APP HAS NO LIABILITY FOR ANY INFORMATION STORED OR PROCESSED ON THE SERVICES. THIS INCLUDES THE COSTS OF RECOVERING SUCH INFORMATION. THE APPLICATION IS NOT RESPONSIBLE FOR THE VALIDITY, RELIABILITY OR ACCURACY OF ANY CONTENT AND INFORMATION PROVIDED IN CONNECTION WITH OR THROUGH THE USE OF THE SERVICES. THE USE OF ANY CONTENT OR INFORMATION OBTAINED THROUGH THE USE OF THE SERVICES IS AT YOUR OWN DISCRETION AND AT YOUR OWN RISK. THE MANDATORY PROVISIONS OF THE APPLICABLE LEGISLATION SHALL APPLY IN PRIORITY

14.Applicable Law

These Terms, along with your access to and use of our Services, will be governed by and interpreted in accordance with English law. Any disputes between the Application and the user shall initially be resolved under English law. If a resolution cannot be reached, both parties agree, declare, and undertake that the courts of England shall have exclusive jurisdiction.

15.Severability

If any provision of these Terms of Service is held invalid or unenforceable, such provision shall be deemed ineffective and shall be deemed to be omitted from these Terms of Service (to the extent that it is invalid or unenforceable), without invalidating any other provision; the remaining portions of these Terms of Service shall apply in any event.

SHORTEN may amend these Terms of Service at any time to ensure that the provisions in the Terms of Service are not contrary to the law and are valid and enforceable.

16.Changes to These Terms

We may change these Terms of Service at any time without any special notice.   Such changes will not apply to any dispute between you and us prior to the date we post the revised Terms, incorporate such changes or notify you of such changes. Your use of the Application following any changes to these Terms will constitute your acceptance of those changes. The latest version of the Terms published on the Application applies to all users. It is your responsibility to check the latest version on the application or on our website. If you do not wish to continue using the APPLICATION under the updated Terms, you may terminate your account by contacting us.

17.Third Party Contents

Where our Services may contain links to other sites and resources provided by third parties. The contents, websites and services of these third parties may be subject to the conditions of the third parties. The Application is not liable for any damages resulting from the content, websites or services of such third parties.

18.Subscription Management and Cancellation

You can cancel your membership at any time, and you will continue to have access to the Application  through the end of your billing period. 

Your subscription purchase, cancellation and refund requests will be evaluated and implemented in accordance with the conditions specified in our Purchase, Cancellation and Refund Policy.

To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial membership periods. To cancel, go to the "Account" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. If you signed up for Application using your account with a third party as a payment method and wish to cancel your membership, you may need to do so through such third party; for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Application service through that third party. To the extent permitted by applicable law, payments are non-refundable, non-transferable, and we do not provide refunds or credits for any subscription.

Under this clause, deleting the Application does not automatically terminate your subscription. For questions regarding any payment method and subscription cancellation, please review our Purchase, Cancellation and Refund Policy and contact our support team.
